Official Rules, Regulations, and Terms & Conditions
Effective Date: March 1, 2026
The Buy. Close. Take Off. program (the “Program”) is a discretionary client appreciation initiative jointly offered through a marketing collaboration between Ana Bastas Realty (“ABR,” the “Team,” “we,” “us,” or “our”), operating under REAL Brokerage Ontario Ltd., Brokerage, and MacDaniel Phillips of Phillips Mortgage (the “Mortgage Partner”).
MacDaniel Phillips is licensed with Dominion Lending Centres Expert Financial Inc. #12129.
Participation in the Program constitutes full acceptance of these Rules, Regulations, and Terms and Conditions (the “Terms”).
The Program is intended for clients who voluntarily choose to complete a residential real estate purchase with Ana Bastas Realty or any of its registered agents and who may also independently choose to obtain mortgage financing services through the Mortgage Partner.
Mandatory Anti–Tied Selling Disclosure
Participation in this promotion does not require the client to use both service providers.
Clients may work with any real estate brokerage or mortgage provider of their choice.
Use of one service provider does not increase or decrease eligibility for the Program.
Participation does not provide any advantage or disadvantage regarding mortgage approval, loan terms, underwriting decisions, interest rates, professional representation, or transaction outcomes.
No client will receive preferential treatment based on participation.
Clients are not required to use the Mortgage Partner to receive real estate services and remain free to select any mortgage provider of their choosing. Similarly, clients of the Mortgage Partner remain free to select any real estate brokerage. Participation in the Program does not create any obligation to engage both service providers. Eligibility for participation in the Program is based solely on the voluntary completion of qualifying services with both participating businesses. Mortgage approval, interest rates, loan terms, underwriting decisions, and lender selection remain entirely independent and are determined solely by the client and the lender.
Participation in the Program does not influence:
• Real estate representation decisions
• Mortgage approval or denial
• Mortgage pricing or loan terms
• Negotiation strategy or fiduciary obligations
• Professional recommendations or advice
No fees, commissions, costs, or remuneration payable by the client are increased, reduced, rebated, or otherwise altered as a result of participation in this Program.
Non-Referral Confirmation
This Program does not constitute a referral agreement.
No referral fees, commissions, compensation sharing, or financial consideration are paid or exchanged between the participating businesses in connection with this initiative.
Ana Bastas Realty and the Mortgage Partner operate as independent businesses. The Program does not create a partnership, joint venture, agency relationship, or financial dependency between the parties beyond the promotional initiative described herein.
Any legally required disclosures regarding professional relationships will be provided separately in accordance with applicable regulatory requirements.
Commission Neutrality Confirmation
Participation in the Program does not affect compensation structures for any participating professionals.
Specifically:
• No change to agent commission splits
• No side agreements between parties
• No bonuses tied to shared transaction volume
• No internal incentive structures related to Program participation
• No adjustments to mortgage broker compensation
All compensation remains consistent with standard brokerage agreements and regulatory requirements.
Incentive Funding
The Program incentive is funded jointly by Ana Bastas Realty and the Mortgage Partner on an equal cost-sharing basis unless otherwise disclosed in writing.
1. Eligibility
1.1 The Program is open only to individuals who:
• Are legal residents of the Province of Ontario, Canada
• Are eighteen (18) years of age or older at the time of participation
1.2 The Program applies solely to residential real estate purchase transactions completed within Ontario.
1.3 Employees, contractors, and representatives of Ana Bastas Realty, REAL Brokerage Ontario Ltd., Brokerage, Phillips Mortgage, Dominion Lending Centres Expert Financial Inc., and their immediate family members may be excluded where prohibited by law or policy.
2. Voluntary Participation & No Requirement
2.1 Participation in the Program is entirely voluntary.
2.2 Clients are not required to use any specific mortgage lender or broker and remain free to select any mortgage provider of their choosing.
2.3 Clients are not required to use Ana Bastas Realty to obtain mortgage services through the Mortgage Partner.
2.4 Ana Bastas Realty does not provide mortgage advice. Mortgage approvals and lending decisions are determined solely by the lender.
2.5 Participation does not influence:
• Representation decisions
• Mortgage decisions
• Negotiation strategy
• Professional services
3. No Inducement or Influence
3.1 Participation is not intended to induce or pressure a client to enter into a representation agreement or mortgage arrangement.
3.2 Clients retain full freedom to select service providers independently.
3.3 The Program is offered solely as a discretionary client appreciation initiative following voluntary completion of qualifying services.
4. Program Mechanics
4.1 For every four (4) qualifying completed client transactions involving both participating businesses, one (1) client shall be selected by random draw to receive a $1,500 CAD travel voucher.
4.2 Each qualifying client has an equal chance of selection within the qualifying group.
4.3 Only fully completed and closed transactions qualify.
4.4 Participation does not guarantee receipt of any incentive.
5. Nature of the Incentive
5.1 The travel voucher is a jointly funded client appreciation incentive.
5.2 The incentive is not:
• A referral fee
• A commission rebate
• A discount on services
• A condition of representation
• An inducement tied to mortgage approval
5.3 Client costs are not altered as a result of participation.
6. Travel Voucher Conditions
6.1 The travel voucher:
• Has no cash value
• Is non-transferable
• May not be redeemed for cash
6.2 Ana Bastas Realty reserves the right to substitute an incentive of equal or greater value.
6.3 Travel providers are subject to availability and discretion.
6.4 Neither party is responsible for third-party travel issues or disruptions.
6.5 Voucher value represents approximate retail value.
6.6 Tax implications are the sole responsibility of the recipient.
7. Draw Procedures & Winner Notification
7.1 A draw shall occur after each group of four (4) qualifying transactions has fully closed.
7.2 Closing is defined as successful registration of title.
7.3 Selection shall be random and administered by the Program organizers.
7.4 Draws may be conducted electronically, virtually, or in person.
7.5 Winners shall be notified using provided contact information.
7.6 Winners may be publicly announced unless declined in writing.
7.7 If a winner cannot be contacted within fourteen (14) days, an alternate may be selected.
7.8 Records may be maintained for compliance purposes.
8. Advertising & Promotional Disclosure
8.1 The Program may be advertised through various marketing channels.
8.2 Advertising is informational only.
8.3 These Terms prevail over promotional materials.
8.4 Marketing language may change without affecting Program Terms.
8.5 All Program marketing materials must receive prior written approval from the applicable Principal Broker(s) before public release.
9. Brokerage & Independent Business Relationships
9.1 Ana Bastas Realty operates under REAL Brokerage Ontario Ltd., Brokerage.
9.2 The Mortgage Partner operates independently under Dominion Lending Centres Expert Financial Inc.
9.3 The Program does not create a legal partnership or joint venture beyond the promotional initiative.
10. Right to Modify or Terminate
10.1 The Program may be modified, suspended, or terminated at any time.
10.2 No vested rights arise from participation.
11. Release, Waiver & Hold Harmless
Participants release Program organizers from claims arising from participation except where prohibited by law.
12. Limitation of Liability
Liability shall not exceed the value of the travel voucher.
13. Force Majeure
Neither party is responsible for events beyond reasonable control.
14. Regulatory Compliance
14.1 The Program is offered in accordance with applicable Ontario real estate and mortgage regulatory standards, including RECO and MBLAA requirements.
14.2 Participants acknowledge the opportunity to seek independent professional advice.
15. Non-Combination
The Program may not be combined with other incentives unless authorized in writing.
16. Dispute Resolution
Disputes shall first attempt good-faith resolution.
17. Governing Law & Jurisdiction
Ontario law applies.
18. Entire Agreement
These Terms constitute the entire agreement.
